Website Terms of Use

We provide a range of advanced chromatography consumables and associated accessories specifically for liquid chromatography and mass spectrometry.

1.1 The websites www.ionoptickscopy.com, helpcentre.ionoptickscopy.com, and other related platforms including our website for retail customers, mobile applications (apps) and digital properties made available on or via this website (collectively, “Sites”) are owned and operated by us.

1.2 These Terms govern your access to and use of the Sites. Please read them carefully and contact us if you have any questions.

1.3 In these Terms, “our”, “we” or “us” means IonOpticks and its related bodies corporate.

1.4 By accessing or using the Sites, you agree to be bound by these Terms and our Privacy Policy as amended from time to time. If you do not agree, you must stop using the Sites immediately.

You agree that:

  • 2.1.1 We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Sites in accordance with these Terms;
  • 2.1.2 You must not do anything unlawful, prohibited, abusive or defamatory on the Sites;
  • 2.1.3 You must not upload or transmit encrypted material, junk mail, unsolicited advertising, invade privacy, encourage criminal conduct, or otherwise violate any law.

2.2 You are solely responsible for any material you:

  • 2.2.1 post, publish or transmit through the Sites (“User Content”); and
  • 2.2.2 obtain through using our services.

We may remove any User Content without notice. You grant us a royalty-free, worldwide, perpetual, irrevocable, non-exclusive, transferable, sub-licensable licence to use, reproduce, modify, store and exploit your User Content for our business purposes.

3.1 The Sites may contain links to third-party websites or apps. We do not control and are not responsible for their content. Access at your own risk.

4.1 “Intellectual Property Rights” means all copyright, patents, trade-marks, designs, trade secrets, domain names, logos, scripts, graphics, source code and similar rights worldwide.

4.2 We own or license all rights in the Sites and their content (“Content”). Your use does not grant any Intellectual Property Rights.

4.3 You must not modify, copy, distribute, display, reverse-engineer, create derivative works from, or sell any Content unless expressly permitted.

4.4 You retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free licence to use and distribute it.

4.5 These obligations survive termination.

5.1 To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, loss of profits, data, use, goodwill or other intangible losses.

5.2 Everything on the Sites is provided “as is” and “as available.” We do not warrant that:

  • 5.2.1 The Sites will meet your requirements;
  • 5.2.2 Content accuracy;
  • 5.2.3 The Sites will be uninterrupted or error-free;
  • 5.2.4 Errors will be corrected.

5.3 You use the Sites at your own risk.

6.1 You agree to indemnify and hold harmless IonOpticks and our officers, directors, employees and agents against any claims, liabilities, damages, losses, costs and expenses (including legal fees) arising from:

  • 6.1.1 Your access to or use of the Sites;
  • 6.1.2 Your User Content;
  • 6.1.3 Your breach of these Terms.

6.2 This indemnity survives termination.

  • 7.1 We may terminate or suspend your access immediately without notice.
  • 7.2 We may discontinue, suspend or limit access to the Sites at any time.
  • 7.3 We are not liable for any loss you suffer under this clause.
  • 8.1 We may revise these Terms from time to time; the current version is always on the Sites.
  • 8.2 Continued use after revisions means you accept the new Terms; otherwise stop using the Sites.
  • 9.1 These Terms are governed by the laws of Victoria, Australia, and disputes are heard in Victorian courts.
  • 9.2 If you access the Sites outside Australia, we do not guarantee compliance with local laws.
